1.1 The Terms of Use provided here regulate the use of our website www.juiceplus.com/nz/en. This website is operated by The Juice Plus+ Company (Australia) Pty Ltd – hereafter referred to as “The Juice Plus Company” or “Juice Plus+.”
1.2 PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE YOU USE THE JUICE PLUS.COM/NZ/EN WEBSITE. BY USING OUR WEBSITE, YOU HAVE AGREED TO ABIDE BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS, YOU SHOULD NOT ACCESS OR USE THIS WEBSITE.
2. Types of Users

7.2 This website and its contents are designed to comply with the applicable laws and regulations of your country of residence. It is intended for access and use only by users in your country. 8.3 Juice Plus+ reserves the right to modify, update, add, discontinue, remove, revise or otherwise change any portion of these Terms of Use, in whole or in part, and at any time. If there are significant or material changes to these Terms of Use, Juice Plus+ agrees to inform you within a reasonable amount of time.
9. Product Orders
9.1 The Juice Plus+ Company sells its branded nutritional and supplement products to consumers on juiceplus.com/nz/en and through Juice Plus+ independent sales partners. Consumers must be eighteen (18) years old or older to make a purchase.
9.2 Any order received by Juice Plus+ in accordance with clause 10.1 below is accepted by Juice Plus+ at its own exclusive discretion. The order is accepted and the contract with you, the customer, is finalised when you receive a confirmation email from Juice Plus+ and/or you receive the products ordered.
9.3 Recurring orders are defined as continuous, on-going orders that have been expressly agreed to by you, the customer, and involve recurring deliveries on an agreed-to schedule.
9.4 In the event that you submit a recurring order, this contract is entered into for an indefinite period of time with both you and Juice Plus+ having the right to cancel. If you cancel a recurring order in the middle of a payment cycle, all remaining payments for your canceled order will be processed at their regularly scheduled time, unless prearrangements have been made. Orders must be canceled within seven (7) calendar days of your recurring ship date to prevent the next shipment and the charge to your payment method.
9.5 Before an order is submitted, you have the right to choose between the option of making a single full payment or agreeing to pay in 4 (four) monthly installments. Juice Plus+ retains the right to refuse an order payment in installments.
9.6 Prices listed on juiceplus.com/nz/en are inclusive of GST.
9.7 In the event that you submit multiple orders, you have the option of choosing between making a single full payment or agreeing to pay in 4 (four) monthly instalments for each individual order.
9.8 You need to know that once you submit an order to Juice Plus+ it is not possible to change that order on the website. For any change after the order is submitted, you need to contact the Juice Plus+ Customer Service team via email to [email protected] or by phone at 0800 100 125.
9.9 All products are subject to availability. Juice Plus+ reserves the right to impose quantity limits on any order, to reject all or part of any order, and to discontinue products without notice, even if you have already placed the order. The Company will, of course, reimburse you for any product not received as a result of any of these circumstances.
9.10 You can manage your own order activity by setting up a personal My Account on this juiceplus.com/nz/en website.
9.11 If you purchase directly from juiceplus.com/nz/en, you will be assigned to one of our local independent partners who will be available to assist you with information about our products or with any of your other customer service needs.
10. Shipping and Delivery
10.1 Any special shipping delivery requests you make will only be honoured when that request has been expressly agreed to and confirmed in writing by Juice Plus+. You acknowledge and agree that only deliveries and dates confirmed by Juice Plus+ are binding, except if clause 10.2 below applies. Juice Plus+ may choose shipping methods at its own discretion.
10.2 You understand and agree that you will not hold Juice Plus+ liable or responsible for any delay in delivery that occurs due to unforeseeable circumstances or events beyond the reasonable control of Juice Plus+ (“force majeure”).
10.3 You acknowledge and agree that Juice Plus+ is no longer responsible for your product delivery once the product is delivered to the address you have indicated.
10.4 Our regular shipping charges are included in the product price you pay. If you request another method of shipping and we agree to it, we may need to apply additional shipping costs.
11. Payment and Other Charges
11.1 You can pay Juice Plus+ product orders and application fees using the following payment options: Visa, MasterCard and American Express.
11.2 Your payment is processed once you have submitted your order to Juice Plus+.
11.3 If you are late – in whole or in part – more than thirty (30) days after a payment is due, a late payment charge of $28.75 NZD may apply. After 45 days the amount due may be forwarded to a third-party collection agency.
12. Returns
12.1 Juice Plus+ is proud of the quality of our products and certifies that they meet our label standards. However, if you are not 100% satisfied, you may return unopened product within six (6) months of the ship date for a full refund. Refer to full Returns Policy.
12.2 You may also return recurring orders – i.e., second shipments and beyond –within 6 (six) months of the ship date for a full refund. Refer to full Returns Policy.
12.3 You may cancel a recurring order at any time during the installment payment cycle. We will continue to collect any remaining installment payments on the scheduled payment dates.
12.4 Juice Plus+ will process refunds using the same payment method that you used for the purchase.
13. Communications Related to Your Order
13.1 By submitting an order, you agree to receive Juice Plus+ commercial communications regarding your order in the form of electronic email, texts, newsletters, etc. using the contact details you provide us in accordance with our Privacy Policy.
14. Enforceability and Disputes
14.1 If individual parts of these Terms of Use are declared wholly or partially invalid or ineffective, the other clauses shall remain in effect.
14.2 Any modification or addition to these Terms of Use requires the written consent of Juice Plus+.
14.3 These Terms of Use will be governed by and construed in accordance with the laws of the State of New South Wales (Australia). For any dispute that the Parties are not able to resolve informally, the Parties agree that the dispute shall be submitted to the jurisdiction of the state or federal courts located in New South Wales (Australia), where the headquarters of the Juice Plus+ Company (Australia) Pty Ltd is located.
15. Liability
15.1 You agree to read the product label before consuming any Juice Plus+ product, and to comply with any measure required to avoid any harmful consequence, including but not limited to cases of special health and/or physical conditions. You agree to give Juice Plus+ prompt notice of any problems you encounter with a product and to cooperate with Juice Plus+ in any investigation of your claims.
15.2 Even though we make a concerted effort to keep juiceplus.com/nz/en free of computer viruses, we cannot guarantee that this is always possible. Prior to downloading information from juiceplus.com/nz/en, you should ensure that you have virus scanners, adequate safety installations, and/or taken other security precautions, both for your own protection and for the protection of the juiceplus.com/nz/en website.
